Peer review of grant applications, it has been suggested, might be distorted by what is popularly termed old boyism, cronyism, or particularism. We argue that the existing debate emphasizes the more uninteresting aspects of the peer review system and that the operation of old boyism, as currently understood would have little effect on the overall direction of science. We identify a phenomenon of cognitive particularism, which we consider to be more important than the institutional cronyism analyzed in previous studies. Aristotle considers all examples, as far as they are used as rhetorical arguments, to be inductions . On the other hand, he finds it worthwhile to distinguish different kinds of examples . Moreover, comparisons and fables are said to be “made” by the orator, whereas historical examples are not . The present article attempts to explain this opposition.A close examination of what can be meant by “induction” reveals that this term applies differently to historical examples and to comparisons and fables. (...) In a broader sense, all examples can be called inductions, insofar as a certain logical relation, different from the syllogistic one, obtains between conclusion and premises. This relation, however, is unable to explain why examples can serve as arguments. Applied to historical examples only, the term “induction” preserves its original meaning of checking samples in a number sufficient to yield generalization. In its narrow sense, “induction” gives a satisfactory account of how historical examples work. As for comparisons and fables — to which “induction” applies in a broader sense only — Aristotle fails to explain what makes them arguments. The explanation, missing in Rhetoric 2, 20, can, however, be given according to the general lines of Aristotelian dialectics and rhetorics. The main task of comparison and fable is to elaborate a so far unconsidered middle term meeting the following conditions: the hearer is prepared to agree that M applies to the subject of the conclusion and that the predicate of the conclusion applies to M. All examples make use of a general proposition from which their conclusion can be inferred. Historical examples produce instances, in order to confirm a proposition previously admitted as suitable premise, provided that its truth can be proved. Comparison and fables, by introducing a new middle term, try to form a premise susceptible of being admitted without proof. (shrink)

Aischylos darf als der eigentliche Schöpfer der Tragödie als literarischer Kunstform gelten, so sehr diese im 5. vorchristlichen Jahrhundert auch an ihren kultischen Ursprung gebunden bleibt. Aischylos führt den zweiten Schauspieler ein und nutzt technische Erfindungen zur Steigerung szenischer Effekte. Außerdem ist er der große Gestalter der tetralogischen Komposition, d.h. der Verbindung dreier Tragödien und eines Satyrspiels zu einer Handlungseinhait, die es ihm ermöglicht, die Verkettung von Hybris, Ate und Dike an ganzen Geschlechtern über Generationen hin zur Darstellung zu bringen. Im Mittelpunkt seines Denkens steht die notwendig schuldhafte Existenz des handelnden Menschen, für den die Erfüllung einer überpersönlichen Forderung zugleich den Verstoß gegen eine andere, ebenso gültige Norm bedeutet. Überbrückt wird diese tragische Weltsicht im Glauben an die von Zeus repräsentierte Weltordnung, die den Menschen im einzelnen zwar unbegreiflich bleibt, deren grundsätzliche Sinnhaftigkeit sich ihm jedoch im Leiden erschließt. Adäquaten Ausdruck findet dieses Denken in einer urtümlichen und gewaltigen Sprache, deren Übersetzung in der hier vorliegenden Ausgabe philologisch präzis ist und gleichzeitig das Verständnis des aischyleischen Dramas erleichtert. Die drei Bücher "Vom rechten Handeln" beschäftigen sich mit dem Verhältnis zwischem dem "Sittlichen" und dem "Nützlichen". Cicero vertritt die These, dass beide Begriffe "von Natur aus" identisch sind. Einen Konflikt zwischen dem Sittlichen, d.h. den aus den Tugenden folgenden Pflichten, und dem Nützlichen kann es daher im Grunde nicht geben. Was immer auf den ersten Blick sich als Konfliktfall darstellen mag - und Cicero geht zahlreiche Beispiele durch -, erweist sich bei genauer Betrachtung stets als scheinbarer Konflikt, der Nutzen (...) als scheinbarer Nutzen. Cicero verfasste "De officiis" als Vermächtnis an seinen Sohn in den Monaten nach der Ermordung Caesars. Von allen Werken Ciceros hat es am stärksten auf die Nachwelt gewirkt, von der Antika an, über Mittelalter, Renaissance bis hin zur Neuzeit; es wurde 1465 in Mainz als erstes gedruckt und am häufigsten übersetzt und kommentiert. Voltaire und Friedrich der Große hielten "De officiis" für das beste Buch über Moral. Die Übersetzung Karl Büchners sucht so wörtlich wie möglich die kunstvolle Sprache Ciceros nachzubilden. This article presents the new German law on advance directives from 1 September 2009. The history of the parliamentary process of this law is described, the present regulations are explained, their relevance for medical practice discussed and shortcomings are identified. Finally, the new law is compared with other regulations in the international context. Previously established legal practice in Germany has now become largely confirmed by the new law: An advanced directive must be respected in any decision concerning medical treatment, regardless (...) of the stage of the illness. It can be informally revoked at any time, even with limited decision-making capacity. Nobody may be obliged to issue a directive in any way. Advance directives do not need notarisation or routine updating after certain time intervals. Provided that the patient, who is no longer mentally competent, has issued a lasting power of attorney, or provided that the patient has been appointed a healthcare proxy by the courts, this authorised surrogate must assert the patient's will. The role of the guardianship court is clarified: it only needs to be involved in cases of disagreement as to the patient's will. The new German law thus combines more legal certainty with a liberal emphasis on patient autonomy and flexible, adaptable regulations. (shrink)

The aim of this paper is to defend a famous quotation from Martin Luther King, stating that “The arc of the moral universe is long, but it bends toward justice.” The quotation is inscribed on the King Memorial in Washington, D.C. and President Obama had it woven into a rug for the Oval Office in the White House. The quotation has become something of a contemporary proverb, and is certainly worthy of our close attention. In order to evaluate the dictum, (...) questions concerning its meaning will first be addressed and clarified, and various possible misinterpretations will be set aside. It will be argued that the appeal, and an effective defense of this moral claim, depend upon the pre-existing values of the people to whom the claim is addressed. The dictum is clearly intended to support hopes of social change and to encourage support for ideals of racial equality, but we want to know whether it is true or false and exactly what it means. King’s dictum can easily be taken as involving a doctrine of “divine Providence” or “historical inevitability.” But many are skeptical of these ideas and hold that we cannot be sure that the future will eventuate in desired moral outcomes. But, if so, what would it possibly mean to claim that the “moral universe” or the human world “bends toward justice”? On the other hand, holding that the moral universe “bends toward justice” claims more than saying that we can now act or organize to support justice; instead, it tells us that there is some pre-existing support for our related activities. What, then, is this pre-existing bend of the moral universe? (shrink)

An seine Freunde - wer da Zeugnisse dessen, was wir Freundschaft nennen, erwartet, wird sich ein wenig enttäuscht finden. Abgesehen von den Briefen an seine Gattin Terentia und seine Freigelassenen Tiro, die eine Sonderstellung einnehmen, gibt sich Cicero nur einigen wenigen Partnern gegenüber ganz so, wie er ist, und das ist doch das, was wir bei einem Freund voraussetzen: Unbefangenheit und Unverstelltheit. Die große Masse seiner Briefe ist zweckgebunden, trägt mehr oder weniger formellen Charakter. Da gilt es, das eigene politische (...) Handeln zu rechtfertigen, das persönliche Verdienst ins rechte Licht zu rücken, Differenzen mit politischen "Freunden" auszufechten, Beziehungen für sich und andere auszuwerten, den politischen Gesinnungsgenossen bei der Stange zu halten oder zu fördern und was dergleichen mehr ist. So leuchten diese Briefe tief hinein in das Treiben der führenden Kreise und bergen mit ihren Schlaglichtern auf das politische Geschehen der Zeit eine Fülle von Interessantem und Fesselndem. Ganz von der Politik diktiert ist der Briefwechsel mit L. Plancus, M. Lepidus, D. Brutus und C. Cassius in den Büchern X, XI und XII. Er bildet eine unschätzbare Quelle für unsere Kenntnis der Vorgänge während des Todeskampfes der Republik. (shrink)

Alzheimer's disease is characterized by plaques of amyloid-beta peptide, cleaved from amyloid-beta protein precursor . Our hypothesis is that lifespan profiles of AD-associated mRNA and protein levels in monkeys would differ from mice and that differential lifespan expression profiles would be useful to understand human AD pathogenesis. We compared profiles of AbetaPP mRNA, AbetaPP protein, and Abeta levels in rodents and primates. We also tracked a transcriptional regulator of the AbetaPP gene, specificity protein 1 , and the beta amyloid precursor (...) cleaving enzyme . In mice, AbetaPP and SP1 mRNA and their protein products were elevated late in life; Abeta levels declined in old age. In monkeys, SP1, AbetaPP, and BACE1 mRNA declined in old age, while protein products and Abeta levels rose. Proteolytic processing in both species did not match production of Abeta. In primates, AbetaPP and SP1 mRNA levels coordinate, but an inverse relationship exists with corresponding protein products as well as Abeta levels. Comparison of human DNA and mRNA sequences to monkey and mouse counterparts revealed structural features that may explain differences in transcriptional and translational processing. These findings are important for selecting appropriate models for AD and other age-related diseases. (shrink)
